Object
These General Terms and Conditions are intended to define the conditions under which (conciergerie-privee-cevennes.fr) SPARTE provides concierge services (listing management, guest check-in, cleaning, maintenance, rate optimization, etc.), as described on the "Services & Rates" page of our website. These services govern the relationship between SPARTE (the "Provider") and the owner or agent of a property (the "Client").

Quote and order
All service requests will result in a personalized quote. The quote will specify the applicable package or commission (see the "Services & Rates" section). The order is considered accepted when the quote is signed or confirmed in writing (letter or email). No service will be performed without written acceptance.

Prices and payment terms
Commissions and service fees are available on the "Services & Fees" page. Unless otherwise stated, commissions are calculated as a percentage of the rent collected. Invoices are payable upon receipt, by bank transfer or the method specified on the invoice. Any late payment will incur penalties at the legal rate and a fixed fee for recovery costs. In the event of non-payment, SPARTE reserves the right to suspend the provision of services until full payment of the outstanding amounts is received.

Description of services
SPARTE offers full or partial property management services (creation and distribution of listings, communication with travelers, check-in/check-out, cleaning, maintenance, linens, etc.) and à la carte services (laundry, transfers, massage, private chef, etc.). The complete list of services can be found in the "Services & Rates" section.

Customer obligations
The Client agrees to provide accurate information and grant access to the property for the performance of services. They guarantee that the property complies with applicable safety and hygiene standards and is insured against rental risks. The Client must also inform SPARTE of any regulations or specific conditions (condominium rules, declarations to the town hall, etc.) that may affect the rental.

Responsibility
SPARTE is only bound by an obligation of means and cannot be held liable for indirect damages (loss of revenue, commercial loss) or for damages caused by travelers. Its liability is in any event limited to the amount of commissions received for the service in question. The Client undertakes to take out insurance covering the risks associated with renting their property.

Termination
The contract may be terminated by either party in writing, with 30 days' notice. In the event of a serious breach of contractual obligations and after a formal notice to remedy the breach has been issued and remains unheeded, either party may terminate the contract immediately. Services already performed before the termination date remain payable.

Mediation and dispute resolution
In accordance with Article L.612-1 of the Consumer Code, in the event of a dispute that cannot be resolved amicably, the Customer may use the services of the consumer mediator CM2C free of charge. (www.cm2c.net, 49 rue de Ponthieu, 75008 Paris)

Data protection
The personal data collected for the performance of services is processed in accordance with applicable regulations. The Client has the right to access, rectify, and delete their data, which they can exercise by contacting SPARTE.

Applicable law
These Terms and Conditions are governed by French law. Any dispute relating to their interpretation or performance shall be subject to the exclusive jurisdiction of the French courts.
